How to give up your asylum claim in Luxembourg

The international protection procedure is extremely long (up to 2 years or more from the time of introduction), with no certainty of obtaining the famous blue passport at the end of it.


It is therefore not uncommon for applicants for international protection to decide to abandon their application in Luxembourg.


What is the procedure to follow?


I.                First step : a meeting with the MAEE


The person who decides to withdraw his/her application for asylum protection must:


-       Notify the Ministry of Foreign and European Affairs ("MAEE")

-       The Ministry will give him/her an appointment. At this meeting the asylum seeker will have to sign a document attesting to the renunciation of his/her application.

 

II.               Second step : Contact the IOM


Once you have signed the waiver, you must contact the International Organisation for Migration ("IOM") to organize your departure from Luxembourg.


You can only return to a country where you have the legal right to stay for a minimum of 6 months or to a country of your nationality.


N.B.: You should know that, if you ever wish to return to Luxembourg and make a new application, your application will be considered as a subsequent application. A subsequent application will entail different deadlines and a different procedure.
